Employees
Employees are paid via our payroll company and payroll taxes will be withheld. By default, the law considers all workers to be employees unless proven otherwise, which means the employer must withhold and remit taxes for them, and provide them with certain benefits. This may go without saying, but employees have to be paid at least minimum wage, according to the laws in the location where they are working. Regular employees working over 25 hrs per week for an SGF project will be eligible for benefits--a cost which must be covered by your project. Part time employees working less than 25 hrs per week and temporary employees (regardless of hours per week) are not eligible for benefits.
Further, projects are responsible for paying for payroll taxes related to their employees. If you are considering hiring employees keep in mind that you will be required to maintain three (3) months of salary and benefits liability in your account at all times. It is each project director’s responsibility to monitor their project funds in Sage and ensure that there are adequate funds to meet payroll. Projects that run out of funds to meet their payroll obligations will be put in the uncomfortable position of laying off their employees before the next payroll is run.
From time to time, legal advice is necessary to properly manage situations involving employees (for example, if an employee makes a complaint alleging harassment or discrimination, an investigation must be done by a qualified attorney), and projects are responsible for covering those costs.
According to Federal and State law, workers are considered employees unless the employer (in this case, SGF) can prove that they qualify for one of the other categories below.
